N2 - This paper aims to reveal the characteristics of the legal relationship between ride-hailing drivers and application companies. Through a juridical-sociological approach, the characteristics are: i) drivers can refuse or accept offers to provide services; ii) the driver has flexibility in working time; iii) the driver has no olbigation to run jobs in one application; iv) the driver is not part of the company; v) the financial risk is borne by the driver; and vi) payment for each service from the user will go directly to the driver's account. These characteristics do not describe the existence of a working relationship between the driver and the application company, for which reason the driver cannot be qualified as an employee, but an independent worker.
